When a soldier was breaking or losing his armament in the struggle or out of her? The one who was paying this one again, the soldier or the state? Some information?

One soldier under Julius Caesar had become separated from the unit, and had to swim to safety for his life, and lost his scutum. He knelt in front of Caesar and begged forgiveness, as to lose one scutum was said to be a death penalty. Caesar reportedly lifted him to his feet, and said "there is nothing to forgive", and bestowed honor on the soldier instead.

I don't know which period of time you are asking about. At certain times, all armor and weapons were bought by the soldier, or by the owner of the legion, later, by the government. I imagine losing a weapon was always considered a serious offense, unless the soldier had been wounded or incapacitated. Breakage was probably considered normal wear and usage. No doubt there was a smith and an armorer along with a large group of men to make repairs and replacements possible.
